1. Agreement to Terms

Welcome to CrochetPoint (“we,” “our,” “us,” or “CrochetPoint”). These Terms of Service (“Terms”) govern your access to and use of our website at crochetpoint.com (the “Website”) and all related services, features, and content (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.

1.1 Who Can Use Our Services

  • You must be at least 13 years old to use our Services
  • If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian’s permission to use our Services
  • You must provide accurate and complete information when creating an account
  • You must comply with all applicable laws and regulations

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the “Last Updated” date at the top
  • We may notify you via email or a notice on the Website
  • Significant changes will be prominently announced
  • Your continued use of the Services after changes constitutes acceptance of the new Terms
  • If you do not agree to the changes, you must stop using our Services

2. Account Registration and Security

2.1 Creating an Account

To access certain features of our Services, you must create an account:

  • You must provide a valid email address
  • You must create a secure password
  • You must choose a unique username
  • All information provided must be accurate and current
  • You must update your information if it changes

2.2 Account Security

You are responsible for maintaining the security of your account:

  • Keep your password confidential – Do not share it with anyone
  • Use a strong password – Combination of letters, numbers, and special characters
  • Report suspicious activity – Contact us immediately if you suspect unauthorized access
  • Secure your email – Your account is linked to your email address
  • Log out on shared devices – Always log out when using public computers

We are not liable for any loss or damage resulting from your failure to maintain account security.

2.3 Account Termination

By You:

  • You may request account deletion at any time by emailing contact@crochetpoint.com
  • Include “Account Deletion Request” in the subject line
  • We will verify your identity and process your request within 30 days
  • Deletion is permanent and cannot be undone
  • All your patterns, progress data, and statistics will be permanently deleted
  • Subscription cancellations follow our Refund Policy (see Section 3.6)

By Us:

  • We reserve the right to suspend or terminate your account if you:
    • Violate these Terms
    • Engage in fraudulent activity
    • Abuse or harass other users (when community features are implemented)
    • Upload illegal or harmful content
    • Attempt to hack or compromise our Services
  • We will provide notice when possible, but may terminate immediately for serious violations
  • You will not receive a refund for any unused subscription period if terminated for cause

3. Membership Plans and Subscriptions

3.1 Membership Tiers

We offer two membership tiers:

Free Membership (Level 1):

  • Create and save up to 10 crochet patterns
  • Access to Pattern Editor
  • Access to Pattern Library
  • Access to Pattern Tracker
  • No timer or statistics features
  • No cost

Premium Membership (Level 2):

  • Unlimited pattern storage
  • Full access to Pattern Editor
  • Full access to Pattern Library
  • Full access to Pattern Tracker with timer
  • Project timer and session tracking
  • Detailed crochet statistics
  • Priority support (when available)
  • All future premium features
  • €3.99 per month

3.2 Subscription Terms

When you purchase a Premium membership:

  • Your subscription begins immediately upon payment confirmation
  • You will be billed on a recurring monthly basis
  • Your subscription automatically renews unless cancelled
  • You can cancel at any time through account settings or by contacting us
  • Cancellation stops future billing but does not provide a refund for the current period
  • You retain Premium access until the end of your current billing month
  • After cancellation, you will be prompted to select which 10 patterns to keep active

3.3 Pattern Limits

Free Members:

  • Limited to 10 saved patterns
  • Must delete existing patterns to save new ones
  • Unsaved patterns (using localStorage) do not count toward limit
  • Attempting to save more than 10 patterns will prompt an upgrade

Premium Members:

  • Unlimited pattern storage
  • No restrictions on number of patterns

After Downgrade from Premium to Free:

  • You will be prompted to select which 10 patterns you want to keep active
  • The 10 oldest patterns are selected by default, but you can change this selection
  • You can change this selection during the cancellation process
  • Active patterns (your chosen 10):
    • Full functionality maintained
    • Can edit, track progress, and view in Pattern Library
    • Progress tracking continues to work
    • Can add/edit markers
    • Can use timer features
  • Locked patterns (patterns beyond your 10):
    • CANNOT be opened or viewed at all
    • CANNOT edit or modify pattern data
    • CANNOT track progress or use Pattern Tracker
    • CANNOT receive marker notifications
    • CANNOT use timer features
    • Are completely inaccessible until unlocked
  • To unlock a locked pattern:
    • You must either upgrade back to Premium, OR
    • Delete one of your 10 active patterns to free up a slot
    • Then you can select a different pattern to become active

3.4 Pricing Changes

  • We reserve the right to change subscription pricing
  • Price changes will not affect your current subscription period
  • You will be notified 30 days in advance of any price changes
  • New pricing applies at your next renewal date
  • You may cancel before the renewal date to avoid new pricing

3.5 Payment Processing

  • Payments are processed securely through Paid Memberships Pro (PMPro) with PayPal
  • We do not store your credit card information on our servers
  • All payment disputes should be directed to contact@crochetpoint.com
  • See our Privacy Policy for details on payment data handling
  • By subscribing, you authorize us to charge your payment method on a recurring monthly basis

3.6 Refunds and Cancellations

14-Day Money-Back Guarantee (First Purchase Only):

  • First-time Premium subscribers may request a full refund within 14 days of their initial purchase
  • Refund requests must be submitted to contact@crochetpoint.com within 14 days
  • Renewal payments are non-refundable – This guarantee applies only to your first Premium subscription purchase
  • After 14 days from initial purchase, all payments are final and non-refundable
  • Refunds are processed within 5-10 business days

Cancellation:

  • You can cancel your subscription at any time through account settings or by contacting us
  • Cancellation stops future billing immediately
  • You retain full Premium access until the end of your current billing period
  • After your billing period ends, your account reverts to Free membership
  • You will be prompted to select which 10 patterns to keep active

4. User Content and Intellectual Property

4.1 Your Content Ownership

You retain all ownership rights to the crochet patterns you create:

  • Patterns you write belong to you
  • Pattern descriptions, notes, and metadata belong to you
  • Images you upload remain your property
  • We do not claim any ownership of your patterns

4.2 License You Grant to Us

By using our Services, you grant CrochetPoint a limited license to:

  • Store your patterns on our servers
  • Display your patterns back to you in the Pattern Library and Tracker
  • Process your patterns to provide features (row tracking, statistics, search)
  • Back up your patterns to prevent data loss
  • Migrate your patterns if we change hosting providers

This license is:

  • Non-exclusive (you can use your patterns elsewhere)
  • Worldwide
  • Royalty-free
  • For the sole purpose of providing our Services to you
  • Terminated when you delete your patterns or account

4.3 Future Pattern Sharing Features

When we implement pattern sharing features:

  • You will have full control over whether patterns are shared publicly
  • You can choose to keep all patterns private
  • Shared patterns will be subject to additional terms (to be updated)
  • We will never share your patterns publicly without your explicit consent

4.4 Our Intellectual Property

All aspects of the CrochetPoint Services are protected by intellectual property laws:

We own or license:

  • The CrochetPoint website design, layout, and interface
  • The CrochetPoint logo, branding, and graphics
  • The Pattern Editor, Pattern Tracker, and Pattern Library functionality
  • All code, software, and technology underlying our Services
  • All text, graphics, and content we create

You may not:

  • Copy, modify, or distribute our code or design
  • Reverse engineer our software or Services
  • Remove or modify any copyright notices
  • Use our branding without written permission
  • Create derivative works based on our Services

4.5 Copyright Infringement

You represent and warrant that:

  • Patterns you upload are your original work or you have permission to use them
  • You will not upload copyrighted patterns created by others without permission
  • You will not infringe on any third-party intellectual property rights

If you believe content on our Services infringes your copyright:

  • Email us at contact@crochetpoint.com with:
    • Your contact information
    • Description of the copyrighted work
    • Location of the infringing content (URL or username)
    • Statement that you have a good faith belief the use is not authorized
    • Statement that the information is accurate and you are the copyright owner or authorized to act on their behalf
    • Your electronic or physical signature

Repeat Infringers:

  • We will terminate accounts of users who repeatedly infringe copyrights

4.6 Prohibited Content

You may not upload or create patterns containing:

  • Illegal content or instructions for illegal activities
  • Hate speech, harassment, or discriminatory content
  • Sexually explicit or obscene material
  • Spam or commercial advertising
  • Malicious code, viruses, or links to malware
  • Personal information of others without consent
  • Content that infringes intellectual property rights

5. Acceptable Use Policy

5.1 Permitted Use

You may use our Services to:

  • Create, edit, and organize your personal crochet patterns
  • Track your progress through patterns
  • Time your crochet sessions (Premium)
  • View your crochet statistics (Premium)
  • Manage your account and subscription

5.2 Prohibited Use

You may NOT use our Services to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Upload harmful, illegal, or offensive content
  • Harass, threaten, or abuse others
  • Impersonate others or misrepresent your identity
  • Interfere with or disrupt our Services
  • Attempt to gain unauthorized access to our systems
  • Use automated tools (bots, scrapers) without permission
  • Sell or transfer your account
  • Share your account with others
  • Create multiple accounts to circumvent pattern limits
  • Engage in fraudulent activity
  • Reverse engineer or copy our software
  • Use our Services for commercial purposes without permission

5.3 Enforcement

We reserve the right to:

  • Remove any content that violates these Terms
  • Suspend or terminate accounts that violate these Terms
  • Report illegal activity to law enforcement
  • Cooperate with legal investigations
  • Take legal action against violators

5.4 Monitoring

  • We do not regularly monitor user content
  • We may review content if we receive complaints or detect suspicious activity
  • Automated systems may flag potentially problematic content
  • We reserve the right to access accounts to investigate Terms violations

6. Service Availability and Modifications

6.1 Service Availability

We strive to provide reliable access to our Services, but:

  • Services are provided “as is” and “as available”
  • We do not guarantee 100% uptime or uninterrupted access
  • Services may be temporarily unavailable due to:
    • Scheduled maintenance
    • Technical issues or server problems
    • Security incidents
    • Force majeure events (natural disasters, etc.)
    • Third-party service disruptions

6.2 Maintenance

  • We will perform regular maintenance on our Services
  • Scheduled maintenance will be announced when possible
  • Emergency maintenance may occur without notice
  • We will minimize disruption whenever possible

6.3 Service Modifications

We reserve the right to:

  • Add, modify, or remove features at any time
  • Change the design or functionality of our Services
  • Update our software and technology
  • Discontinue any aspect of our Services

We will:

  • Notify Premium members of significant changes when possible
  • Provide reasonable notice before discontinuing paid features
  • Not significantly reduce paid features without offering refunds or alternatives

6.4 Service Discontinuation

  • We reserve the right to discontinue our Services at any time
  • We will provide 60 days notice when reasonably possible
  • You will have the opportunity to export your pattern data
  • Pro-rated refunds will be provided for unused Premium subscription time

7. Data and Privacy

7.1 Privacy Policy

Your use of our Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at crochetpoint.com/privacy-policy.

7.2 Data Collection

We collect and process your data as described in our Privacy Policy:

  • Account information (email, username, password)
  • Pattern data and metadata
  • Usage information (page views, feature usage)
  • Timer and progress tracking data
  • Cookies and technical information

7.3 Data Security

  • We implement reasonable security measures to protect your data
  • We use encryption (HTTPS/SSL) for data transmission
  • We store passwords using secure hashing
  • We regularly back up data to prevent loss
  • However, no method of transmission or storage is 100% secure
  • You use our Services at your own risk

7.4 Data Loss

We are not liable for data loss caused by:

  • Technical failures or server issues
  • User error (accidental deletion)
  • Account termination (by you or us)
  • Service discontinuation
  • Force majeure events

To protect yourself:

  • Regularly export or save copies of your patterns
  • Keep backups of important patterns
  • Do not rely solely on our Services for pattern storage

7.5 Data Retention

  • We retain your data as long as your account is active
  • Deleted accounts are permanently removed within 30 days
  • Backups may retain data for up to 30 days
  • Some data may be retained longer to comply with legal obligations

7.6 Your Data Rights

You have the right to:

  • Access your personal data by emailing contact@crochetpoint.com
  • Correct inaccurate data through account settings or by emailing us
  • Delete your data by requesting account deletion via email
  • Object to certain data processing

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Services will be uninterrupted, secure, or error-free
  • Warranties that defects will be corrected
  • Warranties regarding the accuracy, reliability, or completeness of content
  • Warranties that your patterns will be preserved or backed up

SPECIFICALLY:

  • We do not guarantee the accuracy of timer tracking
  • We do not guarantee pattern data will never be lost
  • We do not warrant that our Services meet your specific requirements
  • We do not guarantee compatibility with all devices or browsers

8.2 Pattern Accuracy Disclaimer

  • You are responsible for the accuracy of your patterns
  • We do not review, verify, or validate pattern content
  • We are not responsible for errors in patterns you create
  • We are not liable for projects that don’t turn out as expected
  • Pattern calculations (stitch counts, rows, etc.) are your responsibility
  • The Pattern Analyzer is a tool; you must verify its output

8.3 Timer and Statistics Disclaimer

  • Timer tracking is approximate and may not be perfectly accurate
  • Timer may not work properly if browser is closed or device sleeps
  • Statistics are based on data you provide and may contain errors
  • We are not liable for inaccurate time tracking or statistics

8.4 Third-Party Services

  • Our Services integrate with third-party providers (payment processors, hosting, etc.)
  • We are not responsible for failures or issues with third-party services
  • Third-party services have their own terms and privacy policies
  • We do not endorse or guarantee third-party services

8.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE (AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS) WILL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Loss of patterns or crochet project information
  • Time spent creating patterns that are lost
  • Cost of substitute services
  • Any damages arising from:
    • Your use or inability to use our Services
    • Unauthorized access to your account
    • Data loss or corruption
    • Errors, bugs, or technical issues
    • Service interruptions or downtime
    • Account suspension or termination
    • Reliance on any content on our Services

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF WE ARE FOUND LIABLE, OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF:

  • $100 USD, or
  • The amount you paid us in the 12 months before the claim

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

8.6 Indemnification

You agree to indemnify, defend, and hold harmless CrochetPoint (and our affiliates, officers, directors, employees, agents, and licensors) from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights (including intellectual property rights)
  • Content you upload or create on our Services
  • Any dispute between you and another user

This indemnification obligation survives termination of your account and these Terms.


9. Dispute Resolution

9.1 Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

9.2 Jurisdiction

Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts located in Poland.

9.3 Informal Resolution

Before filing a legal claim, you agree to:

  • Contact us at contact@crochetpoint.com to resolve the issue informally
  • Provide a detailed description of the dispute
  • Give us 30 days to attempt to resolve the issue
  • Engage in good faith negotiations

9.4 Class Action Waiver

You agree to resolve disputes individually, not as part of a class or representative action. You waive any right to participate in class action lawsuits or class-wide arbitration.

9.5 Time Limit for Claims

You must bring any claims within one (1) year of the event that gave rise to the claim. Claims filed after one year are permanently barred.


10. General Provisions

10.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and CrochetPoint regarding our Services and supersede any prior agreements.

10.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

10.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

10.4 Assignment

  • You may not assign or transfer these Terms or your account to anyone else
  • We may assign or transfer our rights and obligations to any successor or affiliate
  • Any attempted transfer by you is void

10.5 Force Majeure

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including:

  • Natural disasters (earthquakes, floods, fires)
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Internet or telecommunications failures
  • Cyberattacks or security incidents
  • Pandemics or public health emergencies

10.6 Survival

The following sections survive termination of your account or these Terms:

  • Intellectual Property (Section 4)
  • Disclaimers and Limitation of Liability (Section 8)
  • Dispute Resolution (Section 9)
  • Indemnification (Section 8.6)
  • General Provisions (Section 10)

10.7 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except for our affiliates, officers, directors, employees, and agents who are covered by the limitation of liability and indemnification provisions.

10.8 Export Controls

You may not use our Services if you are located in a country subject to U.S. trade embargo or if you are on any U.S. list of prohibited or restricted parties.

10.9 Communications

By creating an account, you consent to receive electronic communications from us:

  • Transactional emails (password resets, subscription confirmations)
  • Service updates and security notices
  • Administrative messages
  • Optional marketing emails (you can opt out)

These communications are part of your relationship with us, and you cannot opt out of non-marketing communications.

10.10 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

10.11 Mobile Devices

If you access our Services via a mobile device:

  • Standard data charges from your carrier may apply
  • You are responsible for any such charges
  • We are not responsible for carrier limitations or restrictions

10.12 Feedback

If you provide us with feedback, suggestions, or ideas:

  • We may use them without any obligation to you
  • You waive any rights to compensation
  • We may incorporate them into our Services
  • You grant us a perpetual, irrevocable license to use them
